Subjects subject to penalties for violating regulations on water resource monitoring and supervision

According to Article 1, Article 2, Chapter 1 of Decree No. 36/2020/ND-CP, which regulates the subjects subject to penalties include: This subject includes individuals and foreign organizations that violate administrative regulations in the field of water resources and minerals within the territory, adjacent sea areas, economic exclusive zones, and continental shelves of the Socialist Republic of Vietnam. In addition, the subject also includes those authorized to draw up records and impose administrative penalties in the field of water resources and minerals, as well as related organizations and individuals.

In Article 2, Chapter 1 of this Decree, it also specifies the organizations subject to administrative penalties for violations in the field of water resources and minerals, including:

  • Economic organizations established in accordance with the Enterprise Law and the Cooperative Law, including: private enterprises, joint-stock companies, limited liability companies, partnerships, and units dependent on enterprises (branches, representative offices), cooperatives, and cooperative unions;
  • Foreign investors, economic organizations with foreign investment capital, representative offices and branches of foreign traders in Vietnam, representative offices of foreign trade promotion organizations in Vietnam;
  • State agencies that commit violations not within the scope of state management tasks assigned;
  • Political-social organizations, socio-political professional organizations, social organizations, and professional social organizations; Public non-business units and other organizations as stipulated by law.

Administrative fines for units violating regulations on water resource monitoring and supervision

Units violating will be fined administratively from 30,000,000 VND to 40,000,000 VND for the following violations:

  • Failure to monitor 75% of the required parameters for monitoring and supervision as prescribed.
  • Failure to install monitoring and supervision equipment as prescribed.
  • Monitoring and supervision not conducted at the prescribed frequency.
  • Monitoring and supervision not conducted at the prescribed time.
  • Monitoring and supervision not conducted at the prescribed location.
  • Failure to connect and transmit monitoring and supervision data to competent state agencies as prescribed.

Administrative fines ranging from 60,000,000 VND to 70,000,000 VND will be applied for the following violations:

  • Failure to conduct water resource monitoring and supervision in exploitation, utilization, and discharge into water sources as prescribed.
  • Distortion of monitoring and supervision data for water resources.
